Zipolo is a remote storage and delivery service focused on improving the access of travelers to health and fitness items while staying in hotels. Members ship various workout gear (including, but not limited to sneakers, warm up clothing, exercise wear, etc.) that is stored at a Zipolo location. When members want to call up their items from storage for use at a hotel, they identify their hotel address and dates of stay. Zipolo ships the desired items to the member's hotel in time for their visit. ITEMS MAY ONLY BE SHIPPED TO HOTELS IN THE CONTINENTAL UNITED STATES. Zipolo does not ship items to non-commercial residences. When departing, the member repackages the items in the provided packaging and deposits them in the mail for return to Zipolo's storage facility. After member registers and pays their membership fee, Zipolo sends them a welcome packet. Contained therein is return packaging. The member fills the return packaging with the items that they wish to store with Zipolo in their “locker”. The locker refers to the act of storage with Zipolo and does not limit Zipolo to any specific physical storage constraints. ZIPOLO WILL NOT ACCEPT ANY LIQUIDS, HAZARDOUS MATERIALS, AEROSOLS, WEAPONS, JEWELRY, FURS, AND / OR OTHER VALUABLES AND / OR DANGEROUS ITEMS. Locker contents are guaranteed from loss, damage and theft for a total of $150 / member. Individual loss, damage, and / or other issues will be evaluated on a case by case basis and Zipolo has the right to determine the replacement value at which a refund / credit will be issued up to a maximum of $150 / member.
Items placed in storage with Zipolo will continue to be stored by Zipolo as long as the member is paid and in good standing. If the member allows their membership fee to lapse and / or does not pay the membership fee for the next year, the member will have the option of either having their goods returned to them at a fee determined by Zipolo as part of their initial membership registration, donating their goods, or recycling their goods. They will be able to select these options on an individual item basis.
Items are delivered to the member's requested hotel using either UPS or FedEx. They are returned to Zipolo via USPS. Zipolo requires 10 days of advance notice of a shipment request and commits to shipping items so that they arrive at the member's requested hotel a day in advance of the member's arrival. Zipolo is not responsible for delays in shipping that result after the shipment has been picked up by UPS or FedEx. A tracking number is provided to the member as soon as the member's box ships and notification of arrival is provided to the member as well. It is the responsibility of the member to receive their Zipolo box from the hotel front desk, concierge, business center, etc depending on the hotel's package retrieval policy. Zipolo is not responsible for any charges billed by the hotel for package receipt, storage, retrieval, or any other package handling fees levied by the member's hotel. In the event that the package is not delivered to the hotel as requested and confirmed by Zipolo, Zipolo will refund or credit the member for that shipment.
We reserve the right to process orders and otherwise ship member's items in any manner that we, in our sole and absolute discretion, determine. From time to time we may make available to members the ability to upgrade their shipping speed (e.g. next day, priority, etc.), but Zipolo reserves the right to add this functionality as the business warrants. In addition, we will, in our sole and absolute discretion, determine the size and type of lockers we issue and their location within our distribution network.
Zipolo takes the health and safety of our members very seriously. Zipolo will launder clothing in a way that protects the integrity of the fabric while ensuring clean and fresh smelling items. Zipolo is not responsible for any allergies or other health consequences that may or may not result from the use of or contact with the shoes and / or clothing after being cared for by Zipolo. Zipolo requires a yearly commitment from each member upon registration. The plan the member chooses will specify what the member commitment level is. We will bill the membership fee plus any applicable tax to the Payment Method the member provides to us during registration (or to a different Payment Method if the member changes the member account information). Membership will automatically renew for successive yearly memberships, without prior notice to the member, unless and until the member cancels their membership or we terminate it. The member must cancel their membership before it renews each year in order to avoid billing of the next year's membership fees to the member Payment Method.
The member may cancel the membership to Zipolo at any time. At that time, the member will have the option of having their goods returned to them at a fee determined by Zipolo as part of their initial membership registration, donating their goods, or recycling their goods. They will be able to select these options on an individual item basis. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-YEAR MEMBERSHIPS. To cancel the membership, login to the member account and go to the ‘My Account' page and click the 'Cancel My Account' button. Upon cancellation, the member will be given seven (7) days to identify how whether they would like their items returned, recycled, donated, or disposed of. If choosing to have their items returned, the member is responsible for the shipping costs of returning the items they select for return shipment as well as a handling fee. These charges will be billed directly to the Payment Method previously identified by the member. We reserve the right to terminate the member account for any or no reason.
In the event that a shipment is sent to the wrong address, if the address was entered incorrectly by the member, no refund shall be issued. If the shipment is a result of a Zipolo error, Zipolo will credit the user a comparable shipment or refund the user's payment, depending on the original payment method for that shipment. In the event that a shipment is received and the contents do not match those requested by the member, if this is the result of a Zipolo error, Zipolo will credit the user a comparable shipment or refund the user's payment, depending on the original payment method for that shipment. If the content of the member's shipment are damaged, Zipolo will credit the user a comparable shipment or refund the user's payment, depending on the original payment method for that shipment. If the item is damaged beyond use, Zipolo will compensate the user for the value of the item, up to $150 for total locker contents.
In the event that the member return packaging is lost or damaged the member can return their locker contents in any mailing package. Zipolo is not responsible for mailing customers new return packaging.
Beta versions are made available to Customers for purposes of evaluation and feedback. Customer acknowledges that the Beta Services Customer is evaluating may contain bugs, errors, and other problems and is provided to Customer “as-is.” Therefore, to the extent permitted by applicable law, Zipolo disclaims any warranty, condition and/or liability obligations to Customer of any kind with respect to the Beta Services. Customer also hereby acknowledges that Zipolo has not made any representations, promises or guarantees that the Beta Services will ever be announced or made available to anyone in the future and that Zipolo has no express or implied obligation to Customer to announce or introduce the Beta Services. Customers will be asked to provide feedback regarding their use of the Beta Service(s) and Customer hereby grants to Zipolo a perpetual, royalty-free worldwide license to use an / or incorporate such feedback into any Zipolo product or service (including the Beta Services) at any time at the socle discretion of Zipolo.
THE ZIPOLO SERVICE, INCLUDING ALL FEATURES ASSOCIATED THEREWITH, THE WEB SITE AND ITS CONTENTS ARE PROVIDED "AS IS" WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND AND WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WITH RESPECT TO THE ZIPOLO SERVICE, THE WEB SITE AND ITS CONTENTS. We assume no liability or responsibility for any errors or omissions in the content of the Zipolo Web site, any failures, delays, or interruptions in the shipment of locker contents, delivery of any content contained on the Zipolo Web site, any losses or damages arising from the use of the content provided on the Zipolo Web site, or the Zipolo service. TO THE EXTENT ALLOWABLE BY LAW, WE AND OUR LICENSORS DISCLAIM ALL REPRESENTATIONS AND WARRANTIES, INCLUDING, FOR EXAMPLE, WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. In no event shall Insights Ignited, LLC., parent company of Zipolo, its shareholders, directors, officers, or employees be liable (jointly or severally) to the member for personal injury or any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, business interruption or any other commercial damages or loss, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the use or performance of the Zipolo Web site, its contents or our service, including any features associated therewith. In no event shall our total liability to the member for all damages for losses arising from the use or inability to use our Website, its contents or our service, including any features associated therewith (other than as may be required by applicable law in cases involving personal injury) exceed the amount of one month's membership fee on the member membership plan. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.
FOR GOOD AND VALUABLE CONSIDERATION, the customers of Zipolo jointly and severally agree to indemnify and hold harmless Zipolo and all employees therein from any claim, action, liability, loss, damage or suit, arising from the following: Any injury incurred by or during the use of any locker contents stored, shipped, or received from Zipolo and any corruption on any electronics used to access the Zipolo website.
Zipolo, is free to use any comments, information, ideas, concepts, reviews, or techniques or any other material contained in any communication the member may send to Zipolo ("Content"), including, without limitation, responses to questionnaires or through postings to the Zipolo Web site without further compensation, acknowledgement or payment to the member for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products and creating, modifying or improving the Zipolo Web site or other Web sites. Furthermore, by posting any Content on our site, submitting Content to us, or in responding to questionnaires, the member grant us a perpetual, non-exclusive, royalty-free irrevocable license and right to display, use, reproduce or modify the Content submitted in any media, software or technology of any kind now existing or developed in the future. Please note Zipolo does not accept unsolicited materials or ideas for use or publication, and is not responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to Zipolo. Should the member send any unsolicited materials or ideas, the member do so with the understanding no additional consideration of any sort will be provided to the member, and the member are waiving any claim against Zipolo and its affiliates regarding the use of such materials and ideas, even if material or an idea is used that is substantially similar to the idea the member sent. In light of operational constraints, Zipolo is not responsible for the return of items that are prohibited for transport by mail. These items should under no circumstances be sent to Zipolo in the first place. Items sent to Zipolo by its members that are beyond the scope of acceptable items (acceptable items include sneakers and other workout shoes (excluding hiking boots), workout clothing, and small workout aids, such as braces and rubber bands), will be returned to the owner at the owner's expense, including an additional $10 handling fee. We apologize for any inconvenience and encourage the member to be careful in considering what items to ship to and store with us. By becoming a Zipolo member, member grants Zipolo sole ownership of any correspondence between the parties for Zipolo use at its sole discretion.
By accessing the Zipolo Web site, the member agrees to use the Zipolo service, including all features associated therewith, the Website and its content in accordance with all applicable laws, rules and regulations. In addition, the member agrees not to upload, post, e-mail or otherwise send or transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Zipolo Web site. The member also agrees not to interfere with the servers or networks connected to the Zipolo Web site or to violate any of the procedures, policies or regulations of networks connected to the Zipolo Web site. The member also agrees not to impersonate any other person while using the Zipolo Web site, conduct the member's self in a vulgar or offensive manner while using our service, or use the Zipolo Web site for any unlawful purpose.
We reserve the right to terminate or restrict the member use of our service, without notice, for any or no reason whatsoever. Limitations on Use: The member must be 18 years of age or older to subscribe to the Zipolo service. While individuals under the age of 18 may utilize the service, they may do so only with the involvement of a parent or legal guardian. Zipolo does not intentionally seek to collect information from individuals 18 years of age or younger. Unless otherwise specified, the content on the Zipolo Web site is for the member's personal and non-commercial use. The member may not download, modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from, or offer for sale any information contained on, or obtained from, the Zipolo Web site without our express written consent.
The members are responsible for updating and maintaining the truth and accuracy of the personal information the member provides to us relating to the member account. If the member wants to update the member contact information or change the member payment method, the member should do so by accessing the member account on the Zipolo website. Contact information can be found by clicking the 'contact us' link in the footer on the site.
Zipolo takes information security very seriously and uses reasonable administrative, technical and managerial measures to protect the member personal information from unauthorized access. For example, we utilize Secure Sockets Layering, an industry-standard protocol for certain of the member transmissions to us, in order to encrypt the personal information that the member send to us through the registration and sign up process. We store the member email address and payment method information in an encrypted form.
The member is responsible for maintaining the confidentiality of the member account information and for restricting access to the member's computer or mobile device through which the member accesses their Zipolo account. Users of public or shared computers or unprotected mobile devices should log out at the completion of each visit to the Zipolo Web site.
Unfortunately, no security system can be guaranteed to be 100% secure. Accordingly, we cannot guarantee the security of the member personal information and cannot assume liability for improper access to it. By using this Web site, or providing personal information to us through any means, the member agrees that we can communicate with the member electronically regarding security, privacy, and administrative issues relating to the member's use of this site.
